Your Path to a Green Card: Understanding Form I-485

It’s been quite some time since my last post, as I welcomed my second child in May of this year. Experiencing the journey of motherhood for the second time in your 30s is truly different from doing so in your 20s! Now that my little one is over two months old, I finally have time to share valuable information about immigration, particularly focusing on the I-485 process.

What is Form I-485?

The I-485, or Application to Register Permanent Residence or Adjust Status, is the crucial final step in obtaining your green card in the U.S. Depending on your situation, some companies may sponsor this process, while others may not. As for myself, I navigated the entire I-485 process DIY-style alongside my husband. I submitted our application in October 2024, received a Request for Evidence (RFE) in early June, and by the beginning of July, we had our green cards in hand. 🎉

Why Go the DIY Route for Form I-485?

1. **Filling Out the Application**: The information needed for Form I-485 primarily concerns your own details. Even if you hire a lawyer, you’ll still need to fill out a questionnaire, which is essentially the same as completing the form yourself. No one can provide more accurate information than you can, as you’re well acquainted with your situation. Many folks worry about making mistakes that a lawyer wouldn’t. In reality, it’s often the opposite. Your attention to detail and careful verification will serve you better than handing it off to an intern.

2. **Direct Control**: When you file independently, all notifications—including receipts, RFEs, and your final green card—will come directly to you. This level of control eliminates the frustrating wait times often experienced when relying on a lawyer, who may not always be available to provide updates promptly.

3. **Cost Savings**: Legal fees can be significant. After consulting a common law firm, I learned they typically charge $7,000 for the primary applicant and $2,000 for dependents, not including additional fees for RFEs. Considering the hefty application fees for I-485, the work permit (Form I-765), and health examination costs, making a $10,000 investment in legal fees felt excessive. Instead, I’d rather allocate that money for something more enjoyable! 💵

Understanding the Full Scope of 485

While we often refer to the 485 process as the last step, it’s important to note that for non-NIW categories (EB2, EB3), three forms are required: 485, 485J, and 693 (the health examination form). I plan to elaborate on each of these forms in upcoming posts, so stay tuned! 📋
