What You Need to Know About Long-Term Residency in Germany

Many individuals who obtain the Niederlassungserlaubnis (permanent residency) in Germany mistakenly believe that it grants them everlasting residency. However, it’s essential to understand that this isn’t a “forever” solution!

My own experience in 2020, when I had to leave Germany for an extended period, brought to light some critical details about this residency status 👇

Important Fact: Leaving Germany for More Than 6 Months

According to the German Residence Act § 51 Abs. 1 Nr. 7 AufenthG:

“If the holder of a residence permit leaves Germany for more than 6 months without prior approval or if their center of life (Lebensmittelpunkt) moves abroad, the permit will automatically become invalid.”

This means that if you spend more than six months outside Germany, you risk losing your Niederlassungserlaubnis, even if you initially obtained “permanent residency!”

What Can You Do? Solutions for Extended Absence

Option 1: Leaving Germany for Less Than 15 Years

If you need to be away from Germany for work, family, or special circumstances, you should:

  • Contact your local Ausländerbehörde (foreigners’ authority) in advance.
  • Explain your situation and submit an application.
  • Obtain a temporary waiver document (vorläufige Fortbestandsbescheinigung).

This document allows you to retain your residency rights even if you stay away for more than six months.

Option 2: Living in Germany for More than 15 Years

If you’ve resided in Germany for over 15 years and have a stable income source, you can apply for a “long-term waiver” (Fortbestandsbescheinigung).

My Personal Experience in Hesse

I obtained my temporary waiver document, which only contained my name and date of birth, but was not tied to my residency card number. This is a significant advantage because:

  • The residency card number changes when you get a new passport.
  • Not being tied to a number avoids future complications.

The official informed me that I could take a photo of this document to show as needed. Even if I lost the original, it can be reissued since the foreigners’ authority has it on record.

Steps to Take if Planning to Stay Outside Germany for Over 6 Months

If you already anticipate being away from Germany for more than six months, consider the following:

  • Engage in discussions with your local Ausländerbehörde as soon as possible.
  • Prepare relevant documentation (like proof of work trips or family obligations).
  • Keep all written confirmations, emails, and notifications!
